Please read and accept this Toolbar End User License Agreement and Privacy Policy (hereinafter, the “EULA”)before installing and using the Bibado´s Toolbar (hereinafter, the “Toolbar”).This is a legal agreement between BIBADO INVESTMENTS, S.L. (hereinafter, “BIBADO”),a Spanish company with registered address in 88 Miño Street (28670, Villaviciosa de Odón, Madrid, Spain) holder of the Spanish TaxIdentification number B86262896, and YOU.
This Toolbar offers particular features to the users related to BIBADO´s services. The Toolbar includes any online or enclosed documentation,data distributed to your computer for processing and any future programming fixes, updates and upgrades, content and featurescontained therein by BIBADO services. Toolbar may only be used in connection with the BIBADO services.
If you are an individual, you must be of legal age or have parental or legal guardian consent. If you are using the Toolbar for a company,you must have full powers to enter into this agreement in the company’s name.
By selecting the "Accept" or "Install" button (or another one provided by us) or by downloading, installing or using the Toolbar, youacknowledge and agree this End User License Agreement.
BIBADO is entitled to modify any terms of this EULA at any time. BIBADO shall inform you about the all modifications of the EULA bypublishing it in our website. If you do not agree the new terms and conditions of the EULA, please do not use Toolbar. Your continued useof the Toolbar and the services shall constitute your acceptance of such revised EULA.
BIBADO offers a Toolbar to improve the users browsing experience. This is an executable software that enables you to use the services provided byBIBADO or by third parties.
As part of the installation process of the Toolbar, BIBADO may offer changes to your Internet browser settings. These changes can bereconfigured by you at any time from the options dialog available on your Internet browser. Such changes may include the following:
(i) The homepage of your Internet Browser;
(ii) The default search engine in your Internet Browser's built-in search box;
(iii) The page displayed when opening a new tab.
Upon installation, the Toolbar shall be added to your Internet browser in the form of a toolbar. The Toolbar features, widgets and controls aredetermined by BIBADO. It also provides you with a search box, and easy access to powerful Web search directly from your browser. TheToolbar for Internet Explorer can be minimized by right clicking the Toolbar and selecting it. In addition, you will receive assistancefeature which provides you with relevant search results when you place a search query in the browser address bar.
The user may uninstall the Toolbar following the instructions below:
(i) To uninstall the Toolbar, you may use the standard uninstall procedures offered by your computer's operating system and/or by yourInternet browser.
(ii) To uninstall from Internet Explorer – from Windows "Add/Remove Programs" dialog, find the Toolbar in the list of installedapplications and click on it, and then click on the "Uninstall" button.
(iii) To uninstall from Firefox – from the "Extensions" menu, find the Toolbar in the list of installed extensions and click on it,the click on the "Uninstall" button.
Upon installing the Toolbar, the user shall be notified that following the downloading of the Toolbar, his/her workstation may receive relevantadvertisements and offers of services. By accepting this EULA, you expressly consent on the reception of said relevant advertisementsand offers of services. User is free, at all times, to opt-out from his/her workstation receiving such advertisements and offers ofservices by taking the following alternative steps:
(i) Uncheck the box of receipt of such advertisements and offers; or
(ii) Remove the Toolbar from the Add/remove dialog on the operating system; or
(iii) Disable receipt of such services by following the "Disable Page" on the Toolbar.
For further details about the privacy policy practiced by BIBADO, please refer to the privacy policy stated in clause 7 below.
The Toolbar is being licensed to you by BIBADO for private personal use only. Subject to the terms of this EULA, BIBADO grants you a limited,non-exclusive, personal, revocable, non-sub licensable, non-assignable and no-transferable license to download, install, use,access, display and run the Toolbar.
You accept and agree that BIBADO or third parties developers and affiliates of BIBADO own all rights of the Toolbar, including withoutlimitation all intellectual property rights therein. The Toolbar is protected by all copyright, trademark, others statutory and commonlaw and international treaties. You must not delete or alter the copyright, trademark, and other proprietary rights notices ormarkings appearing on the Toolbar delivered to you.
This EULA entitles you to use the Toolbar on a single computer or device controlled by you solely for private personal use only. In thissense, you are not entitled to copy the Toolbar except as necessary to install and use a single copy of the Toolbar on your computer.
You shall have no right:
(i) to assign, sublicense, distribute, rent, lease, loan, lend and/or otherwise transfer the license, or any part thereof, to a thirdparty;
(ii) to make changes and/or other amendments of the Toolbar, including reverse engineer, reverse assembly and reverse-compiling.
All rights not expressly granted to the Licensee are reserved for BIBADO.
In case BIBADO adds to its catalogue new or updated versions of its existing Toolbar, BIBADO may inform you about new versions.Notwithstanding the abovementioned, BIBADO shall not provide, by default, upgrade functions to you.
BIBADO does not offer warranties on the Toolbar, except for the statutory liabilities set forth in consumer legislation and civil law.
BIBADO is doing the best to ensure the continuity, security and quality of the Toolbar based on state-of-the-art technology and practices.However, BIBADO does not guarantee the permanent availability, continuity of the functioning of the Toolbar, the failure-prooffunctioning, the absence of viruses or other elements after the installation that could cause changes to your computer system, or thereliability, usefulness, truthfulness, accuracy, completeness and up-to-date nature of the information included in the Programs, andtherefore BIBADO accepts no responsibility if any of these circumstances occur.

You shall use the Toolbar according to the terms and conditions herein and the applicable laws, regulations and policies. BIBADO shall notbe liable for any damages arising from your use of the Toolbar in a manner contrary to this EULA.
Except for the statutory liabilities set forth in consumer legislation, you exonerate BIBADO from any liability arising from an improperexecution of Toolbar or the malfunction of the Toolbar arising from the manner in which you ran the Toolbar.
BIBADO states that this license to use the Toolbar does not infringe any previous agreement or current legislation.
To the extent permissible by the law, in no event shall BIBADO or any of its third party developers or affiliates, be liable for tradinglosses, profit losses, data losses or any other direct or consequential damages or losses arising out as result of the usage ofany of the Toolbar or whatever other BIBADO services provided by BIBADO or by third parties.
BIBADO does not assume liability in the event of an unforeseeable circumstance or force majeure. Likewise, BIBADO shall not be liablefor any causes beyond reasonable control.
BIBADO provides a Toolbar which allows third party software to develop, maintain and publish their own applications, software or, in othercases, services (hereinafter, the “Third Party Software” or “Third Party Service”).
Third Party Software is a software application including any content, links or materials that are made available via the Toolbar and sometimesprovides Third Party Services. In this sense, when you use any external Third Party Software or Third Party Service you should bearin mind that when accessing these networks you are leaving the Toolbar in order to access an environment that is not controlled byBIBADO. Consequently, BIBADO shall accept no responsibility whatsoever due to any possible infringements or violations of thesecurity of said Third Party Software or Third Party Service.
In addition, (i) your use of any Third Party Software or Third Party Service is subjected to any terms and conditions provided with suchthird party and are not governed by this EULA but is governed by the terms applicable to each software or service (hereinafter, the “Other Terms”)and (ii) BIBADO does not have any obligation to test Third Party Software or Third Party Service and is not responsible for theappropriateness, completeness, stability or legality of any Third Party Software or Third Party Service.
Regardless of the above mentioned, to the maximum extent permitted by law you acknowledge that the entire risk arising out of the use orperformance of the Toolbar and BIBADO services remains with you.
Moreover, in the event of any conflict with the express terms of this EULA, the Other Terms shall control your use of the relevant Third PartySoftware or Third Party Service. Thus, BIBADO recommends you to review the third party terms of use and privacy policy.
You may link to third party sites through the use of the Toolbar. The third party websites and software are not under the control ofBIBADO, and BIBADO is not responsible for the contents of any third party websites or software, any links contained in third partywebsites, or any changes or updates to third party websites. BIBADO is not responsible for webcasting or any other form of transmissionreceived from any third party sites. BIBADO is providing these links to third party websites to you only as a convenience, and theinclusion of any link does not imply an endorsement by BIBADO of the third party website. In this sense, BIBADO cannot guarantee thetechnical availability, quality, reliability, accuracy, truthfulness, validity and legality of any material or information contained in anyof said links.
Therefore, if you become aware of the illicit nature of any activities carried out through third party websites with links on the Toolbar, you shallimmediately notify BIBADO so that it can proceed to deactivate the access link to said websites.
The license to use the Toolbar under this EULA is perpetual.
Notwithstanding the abovementioned, this Agreement could be terminated automatically as provided for in this EULA in case of:
(i) you reverse engineering, reverse-compiling, reverse assembly or otherwise infringing BIBADO´S proprietary rights by Licensee, itsLicensee Partners;
(ii) you violate of the license grants or restrictions;
(iii) you distribute the Toolbar without the appropriate license or permission;
(iv) you do a misuse of the source code of the Toolbar.
Regardless of the above mentioned, you may terminate this EULA at any time. Upon termination of this EULA for any reason (i) all licenses and rightsto use the Toolbar and services shall terminate and (ii) you must remove the Toolbar from your computer equipment and dispose of alloriginals and copy of the Toolbar in your possession.
In case of dispute between the parties the Spanish legislation will be applied.
Any dispute shall be settled by judges and courts of the city of Madrid (Spain).
This Privacy Policy shall come into effect in the event that BIBADO collects from you or you provide to BIBADO personal data byinstalling or using the Toolbar. BIBADO guarantees its compliance with Organic Law 15/1999 of 13th December on the Protection ofPersonal Data and its implementing regulations.
All personal information that you provide BIBADO shall be added to the file that BIBADO has duly registered before the General DataProtection Registry
The Toolbar may collect and process personal information provided by you just for statistical purposes. In particular, when you use one of theToolbar search feature to search the Web, the query reaches certain information. The Toolbar uses this information in order toappropriately process your search request and to serve you relevant and better search results. The Toolbar sends a configuration requestwhen you start your browser. This request includes only data such as browser type & IP address. In addition, occasionally the Toolbarplatform may send a request to BIBADO servers to check for new version releases. All of the collected information is kept strictlyanonymous, is non-personally identifiable, and is used only for purposes of delivering better search services and content inaccordance with your preferences.
Importantly, all collected information of search queries are recorded on a non-personally identifiable basis and kept strictly anonymous. Allsearch activity information is researched and evaluated only on an aggregated basis (except in response to a customer service inquiry orlegal process), and we do not disclose any non-aggregated information to third parties, except as required by a valid legal process such asa search warrant, statute, subpoena, or court order, or to protect someone's safety.
BIBADO may use cookies to store a code designation or a distribution source for the Toolbar. BIBABO also may use cookies to (i) the purposes listed above and (ii) counting how many times the toolbar was loaded in order to improve the Toolbar and offer you better service. BIBADO does not use cookies to track your use of the Internet. Moreover, the user is free to de-activate and/or eliminate cookies by following the Internet browser instructions.
At any given time, you have the right to disable some or all services provided through the Toolbar. These services include contextual advertising components.

The Toolbar follows generally accepted industry standards to protect the personally identifiable information submitted to BIBADO, both during transmission and once BIBADO receives it. Notwithstanding, no method of transmission over the Internet, or method of electronic storage, is 100% secure. However, while BIBADO strives to use commercially acceptable means to protect your personal information, BIBDO cannot guarantee its absolute security.
Notwithstanding abovementioned, in response to the concern of BIBADO about guaranteeing the security and confidentiality of your personal data, BIBADO has adopted the security standards demanded by the personal data protection regulations and BIBADO has also installed all technical means within BIBADO power in order to avoid the loss, misuse, alteration, unauthorized access or theft of the supplied personal data that is collected through the Toolbar. Nevertheless, you should bear in mind that security measures on the Internet are not impregnable.
You are entitled to access your personal data so that BIBADO can inform you how BIBADO processes them and for what purposes, to notify us that BIBADO should rectify your personal data, object to us using your data for a specific activity or request that BIBADO cancels your data if you no longer wish BIBADO to process them.
